Terms of Service

These Terms govern access to and use of the screenshot-x402 service (the “Service”) operated by Build In HK Limited (“we”, “us”) in Hong Kong Special Administrative Region. By using the Service (including MCP clients and x402 payers), you agree to these Terms.
1. The Service
The Service exposes MCP tools over HTTP (including take_screenshot, analyze_screenshot, and
health). Features, pricing, and availability may change; tool descriptions
and list prices appear in discovery metadata (GET /discovery.json) and documentation (GET /docs).
2. Security — wallets and keys
Never paste blockchain private keys, seed phrases, or raw signing material into chat prompts, support tickets, or public forums. Configure production agents with keys from a secret manager, vault, or encrypted env (e.g. CI/CD secrets, Cloudflare Workers secrets for server-side config only — not for end-user wallets). You are solely responsible for compromise of keys you expose. We will not ask you to disclose private keys to deliver the Service.
3. Eligibility and acceptable use
You may use the Service only where you have the legal right to do so. You will not use the Service to violate applicable law (including Hong Kong law where it applies), infringe third-party rights, or abuse infrastructure. Without limitation, you must not:
- Instruct the Service to capture or analyse URLs you are not authorised to access, or to bypass technical, contractual, or access controls (including paywalls, authentication, or rate limits) except where you have explicit permission from the website owner or where such controls do not prohibit automated access under applicable law.
- Use the Service to scrape, harvest, or bulk-download third-party sites in breach of those sites’ terms, robots rules, or law, or to build a competing dataset where prohibited.
- Use the Service to harm, harass, or overload systems, or to distribute malware or unlawful content.
- Misrepresent identity, evade payment, or manipulate the x402 or facilitator flow.
- Use the Service in connection with sanctions, export controls, or illegal activity. You represent that you are not barred from receiving the Service under applicable sanctions or trade rules (supplement with sector-specific compliance if you need it).
If you resell access, bundle the Service, or expose it to your own customers, you are responsible for their use and for ensuring they comply with these Terms and applicable law, including intellectual property and data protection obligations arising from screenshots of third-party sites.
4. Payments (x402)
Paid tools are settled through the x402 payment protocol and compatible wallets and networks. You are responsible for correct configuration, sufficient funds, and network fees. Blockchain transactions may be irreversible. We do not custody your wallet or tokens; we receive settlement per the protocol configuration (e.g. USDC to a published recipient address).
Fees and refunds: Fees for successfully invoked paid tools are non-refundable except where mandatory applicable law requires otherwise (for example, certain consumer rights may apply depending on how you purchase — seek advice if you market to consumers in Hong Kong or elsewhere).
5. Third-party websites and content
Screenshots and analyses may depict or derive from third-party websites. We do not control and are not responsible for that content. You obtain outputs at your own risk and must comply with applicable laws, licences, and each site’s terms. We do not warrant that capture or use of any particular URL is lawful for your purpose.
6. Intellectual property
We retain rights in the Service. Subject to these Terms and third-party rights, you may use outputs you lawfully obtain for your internal or agreed commercial purposes. You grant us a limited licence to process your requests and operate the Service (including caching where you enable it).
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the laws of Hong Kong Special Administrative Region (including the Hong Kong Control of Exemption Clauses Ordinance (Cap. 71) where it applies). If you are a consumer within the meaning of the Control of Exemption Clauses Ordinance (Cap. 71), nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded by law.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, DIRECTORS, AND PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED HKD 100 IN ANY TWELVE-MONTH PERIOD.
9. Indemnity
You will defend, indemnify, and hold harmless Build In HK Limited and its affiliates and personnel from third-party claims, damages, losses, and reasonable legal costs arising from: (a) your use of the Service or outputs; (b) your instructions or target URLs; (c) your breach of these Terms or applicable law; or (d) disputes between you and third parties whose sites or content you capture. We may assume exclusive defence at your expense if we reasonably believe there is a conflict. Our right to indemnification under this Section 9 shall not be limited by the cap on liability in Section 8. For the avoidance of doubt, your indemnity obligations to us are uncapped.
10. Suspension and termination
We may suspend or limit access to protect the Service, other users, or to comply with law or requests from competent authorities. Where practicable and lawful, we may give notice before suspension; emergency or legal-process situations may not permit prior notice. You may stop using the Service at any time.
11. Governing law and disputes
These Terms are governed by the laws of Hong Kong Special Administrative Region. The courts of Hong Kong shall have exclusive jurisdiction, except that we may seek injunctive or equitable relief in any competent forum.
12. Data retention
We retain screenshots and analysis outputs only as long as necessary to provide the Service, unless a longer retention period is required by law. You may request deletion of your data by contacting hello@buildinhk.com, and we will comply within 30 days where we are not legally required to retain it.
